A Legal Perspective On Using Facebook And MySpace

I have been waiting for a legal look at using Facebook and MySpace as a recruiting and background check tool. George Lenard who writes George’s Employment Blawg takes a run at it with Steven Rothberg and CollegeRecruiter.com.

The post is Employers Using Facebook for Background Checking: Is It Legal? and takes a good look at issues employers may (or may not) have with discrimination law, invasion of privacy, and terms of service violation.

George ends his post with a “Thinking Practically” section that is some of the best-written advice I have seen for both employees and employers.
